Terms of Service

These terms cover your use of the Over My Head app. Tapping Play means you accept them. If you do not, please do not use the app.

Using the app

You may use Over My Head for personal, non-commercial entertainment. You may not copy, resell, reverse-engineer, or redistribute the app or its decks, or extract its content for use in another product.

Purchases

Purchases are one-time. There are no subscriptions, no consumable currency, and nothing you buy expires. Purchases are processed by Apple or Google under their own terms, and refunds are handled by them, not by us.

Purchases apply to one app store only. Because the app has no user accounts, a purchase made on the App Store cannot be recognised on Google Play, or the other way around. Buying on one platform grants nothing on the other. Use Restore Purchases to recover purchases made on the same store with the same account.

Decks you create

Decks you write stay yours. They are stored on your device, not on our servers, and we cannot see them. You are responsible for what you put in them, and for anything you share.

By creating or sharing a deck, you agree not to include:

Decks you import from a link are checked against the same content rules as our own decks, and a deck containing prohibited content is refused. Every deck you import can be reported and deleted from your device.

We cannot do more than that, and you should know why. A share link contains the deck itself rather than pointing at a copy held on a server. We never receive it, we have no record that it exists, and there is nothing for us to take down. Once you send someone a link, you cannot un-send it.

Content in the app

The decks that ship with the app are our own work. Where a card names a real work, person, or thing, it does so descriptively, as the subject of a guessing game. No endorsement or affiliation is implied, and no trademark is claimed.

Playing safely

The game involves holding a phone to your forehead and moving. Look where you are going, give yourself room, and hold onto the phone. You are responsible for playing somewhere it is safe to do so.

No warranty

The app is provided as-is. We do not promise it will be uninterrupted or error-free, or that motion controls will work correctly on every device โ€” phone hardware varies, which is why tap controls are always available as a full alternative.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of your use of the app is limited to the amount you paid for it. We are not liable for indirect or consequential damages.

Changes

We may update these terms. The date at the top of the page changes when we do, and material changes will be noted in the app's release notes. Continuing to use the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of New York, United States.
